These Terms of Service ("Terms") govern your access to and use of Chealth's services, including our reproductive health monitoring platform and imaging devices. By using our services, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By creating an account, renting our equipment, or using our services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.
2. Eligibility
You must be at least 18 years old to use our services. By using Chealth, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- All information you provide is accurate and complete
- You will maintain the accuracy of such information
3. Service Description
Rental Service
Chealth offers a rental service for medical imaging devices designed for reproductive health monitoring. The service includes:
- Rental of CE-marked imaging probe and compatible smartphone
- AI-guided scanning application
- Professional review of scans by certified sonographers and radiologists
- Reports and insights about your reproductive health patterns
Non-Diagnostic Nature
Whilst our device holds CE marking, Chealth is a non-diagnostic service. The device would need to be operated by a healthcare professional (such as a healthcare assistant or above) for scans to be considered diagnostic. Our service provides insights and information for personal health monitoring but does not constitute medical diagnosis, treatment, or advice.
4. Pricing and Payment
Service Fees
- Initial Programme: £2,000 for two weeks of service, including equipment rental and professional scan reviews
- Extended Monitoring: £500 per additional week
Payment Terms
- Payment is required in full before equipment dispatch
- All fees are non-refundable unless otherwise specified
- Prices are subject to change with notice to existing customers
- You are responsible for any applicable taxes
5. Equipment Rental and Return
Rental Period
The rental period begins when you receive the equipment and ends on the specified return date. You must return all equipment within 48 hours of the rental period ending.
Equipment Care
You agree to:
- Use the equipment only as instructed and for its intended purpose
- Keep the equipment safe, secure, and in good condition
- Not modify, repair, or tamper with the equipment
- Not allow any other person to use the equipment
- Follow all cleaning and maintenance instructions provided
Return Requirements
- Return all equipment in the original packaging
- Include all accessories, cables, and documentation
- Use the prepaid return label provided
- Ensure equipment is properly sanitised according to our guidelines
Damage and Loss
You are responsible for the equipment during the rental period. You agree to pay for:
- Any damage beyond normal wear and tear (up to £5,000 replacement cost)
- Lost or stolen equipment (full replacement value)
- Late return fees (£100 per day after grace period)
6. Your Responsibilities
Accurate Information
You must provide accurate health information and update it as necessary. Failure to provide accurate information may affect the quality of insights you receive.
Proper Use
- Follow all instructions for device use and scanning procedures
- Use the service only for personal, non-commercial purposes
- Do not share your account credentials with others
- Do not attempt to reverse engineer or copy our technology
Medical Care
You understand and agree that:
- Chealth does not replace medical care or professional consultation
- You should consult with qualified healthcare providers for medical advice
- You will seek immediate medical attention for any health emergencies
- You are responsible for your own healthcare decisions
7. Intellectual Property
Our Rights
All content, features, and functionality of our service, including but not limited to text, graphics, logos, software, and AI algorithms, are owned by Chealth and protected by intellectual property laws.
Your Content
You retain ownership of your health information and scan data. However, by using our service, you grant us a licence to:
- Process and analyse your scans to provide service to you
- Use de-identified, aggregated data for research and service improvement
- Share scans with healthcare professionals for review purposes
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Chealth provides services "as is" and "as available" without warranties of any kind
- We do not warrant that our services will be uninterrupted, error-free, or completely secure
- We are not liable for any health outcomes, medical decisions, or consequences arising from use of our service
- Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the fees you paid for the service
- We are not liable for any indirect, incidental, consequential, or punitive damages
10. Indemnification
You agree to indemnify and hold harmless Chealth, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of our services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Damage to or loss of our equipment whilst in your possession
11. Termination
By You
You may terminate your account at any time by contacting us. You remain responsible for completing any active rental periods and returning equipment.
By Us
We reserve the right to suspend or terminate your access to our services at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Failure to return equipment
- Any reason at our discretion with notice
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through our platform. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Chealth regarding use of our services.
